Terms of Service — Mixprism Pro

Mixprism Pro is a subscription service operated by Damien Chapus, Entrepreneur Individuel (sole trader) registered in France under SIRET 48240994300024 (RCS Antibes). Registered office: 14 Avenue des Jonquilles, 06600 Antibes, France. VAT number: FR26482409943.

VAT regime: Mixprism Pro operates under the "franchise en base de TVA" regime (art. 293 B of the French Code Général des Impôts). VAT is therefore not charged on subscription fees. Prices shown are final prices.

Mixprism Pro provides analytics on tracks indexed in the Mixprism database (mixprism.eu), including but not limited to: play counts, average listening duration, playlist add/remove rates, retention curves, and predictive scoring (where applicable to the subscription tier).

Beta status: Mixprism Pro is currently in active development. Some KPIs and features (advanced retention metrics, predictive scoring, PDF reports) are progressively deployed. Subscribers acknowledge that some features may be unavailable at signup and become available later during the subscription period.

Data accumulation: Listening events are tracked forward in time. Historical data prior to the deployment of the event tracking system is not available. KPIs become more accurate as more data accumulates.

Two subscription tiers are available:

• Artist (€49/month): 1 artist account, up to 20 tracked IDs, basic KPIs, CSV export.
• Label (€199/month): Up to 10 artists, advanced KPIs, predictive scoring, PDF reports (when deployed).

All prices are in Euros (EUR), exclusive of applicable VAT/taxes collected automatically based on the customer's billing country.

14-day free trial: A credit card is required at signup. No charge is made during the trial. The first charge occurs on day 15 unless the subscription is canceled before that date.

Subscribers may cancel at any time via the customer portal accessible from their dashboard. Cancellation takes effect at the end of the current billing period; access is retained until then.

30-day money-back guarantee: If unsatisfied within 30 days following the first paid charge, contact us at hello@mixprism.eu for a full refund of that charge. After 30 days, standard cancellation rules apply (no prorated refunds).

To access analytics for specific tracks, subscribers must claim ownership of the relevant tracks. Each claim requires proof of artist or label ownership (e.g., link to verified social account, label official website, distributor record). Claims are reviewed manually by Mixprism staff, typically within 24-48 hours.

Submitting false claims or claims for tracks not owned by the subscriber is grounds for immediate termination of the subscription without refund.

Important: Mixprism Pro is an analytics service and provides data only. Mixprism makes no guarantee, express or implied, about the commercial performance of any track based on the analytics provided. Decisions to release, polish, shelve, or promote tracks based on Mixprism Pro data are made at the subscriber's sole discretion and risk.

Mixprism is bound by an obligation of means (obligation de moyens), not of results. We use reasonable efforts to provide accurate analytics; however, the accuracy depends on factors beyond our control (e.g., the volume and quality of indexed DJ sets, user behavior, third-party platform limitations).

Mixprism indexes DJ set tracklists from public sources (primarily YouTube). Track timecodes within mixes may be imprecise (sourced from human-submitted descriptions) and may impact the accuracy of listening duration metrics. Mixprism endeavors to improve timecode accuracy but does not guarantee precision.

All listening events are anonymized via salted SHA-256 hashing before storage. No personal data of listeners is exposed to Mixprism Pro subscribers. Subscriber account data (email, billing information) is governed by our Privacy Policy and Data Processing Agreement (DPA).

To the maximum extent permitted by applicable law, the total cumulative liability of Damien Chapus EI arising from or related to the Mixprism Pro service is limited to the amount paid by the subscriber during the 12 months preceding the claim.

Damien Chapus EI shall not be liable for indirect, incidental, special, or consequential damages, including but not limited to loss of profits, revenue, or commercial opportunities arising from decisions made on the basis of analytics provided.

Damien Chapus EI may update these Terms by posting a revised version on this page. For material changes, we will notify active subscribers by email at least 30 days before the changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.

These Terms are governed by the laws of France. Disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of France, except where consumer protection laws grant the consumer a different jurisdiction.
